On May 9, 2016 the EEOC issued a new "resource document" aimed at employers who have not gotten this one right. In fact, the EEOC has specifically targeted employers who have developed policies that "unlawfully restrict the use of leave as a reasonable accommodation". According to the EEOC, this has led to a troubling trend in which the EEOC has seen an increase in ADA complaints alleging discrimination based upon disability. As a result, the EEOC decided it was time to help employers understand "how to approach requests for leave as a reasonable accommodation so that employees can manage their health and employers can meet their business needs."
